Abstract

Kadilangu Village in Demak Regency is a former Perdikan Village with historical and religious significance. Over time, the Perdikan land has experienced issues related to unclear legal status and difficulties in obtaining certification. Furthermore, the construction of the Semarang-Demak Toll Road, which passes through the area, has created problems in land acquisition and compensation. The purpose of this study was to determine the legal status of Perdikan land in Kadilangu Village, the implementation of compensation, issues arising during and after the land acquisition process, and solutions to address these issues. The research method used was qualitative with a descriptive approach through interviews, observation, and document study. The results indicate that the legal status of Perdikan land in Kadilangu remains unclear due to differences between historical legitimacy and the land law system. While land acquisition implementation complies with applicable regulations for compensation, in practice, issues arise related to disputes over who receives compensation and the emergence of dual claims between foundations, leading to internal conflicts between foundations. This issue is resolved through litigation to produce a binding decision, ensuring legal certainty for those receiving compensation. Therefore, clarity regarding the status of the freehold land is necessary to ensure fairness and legal certainty for the land acquisition process.
