Abstract
The Dayak Iban Menua indigenous community of Sungai Utik, Kapuas Hulu Regency, West Kalimantan Province, has a strong bond with their customary land as a place of residence, a source of livelihood, and a cultural identity passed down through generations. The implementation of customary land registration for these indigenous communities aims to strengthen the recognition of customary rights and improve community welfare. To provide legal certainty over customary areas, the government is implementing a customary land registration program by issuing Management Rights Certificates (HPL). This research uses a qualitative method with a phenomenological approach to see and understand the direct experience of the community regarding the implementation of customary land registration. This research data was taken from observations, interviews, and document studies of land offices, customary law communities, village officials, traditional institutions, and parties involved in the implementation of customary land registration. The results of this study indicate that customary land registration provides certainty for the customary land of the Dayak Iban Menua Sungai Utik customary law community. Most customary law community groups welcomed the implementation of land registration carried out by the government on their customary land. However, after the HPL was issued, issues arose that worried the community regarding tax payment obligations that were not transparently communicated at the outset, and doubts about the benefits obtained from the customary land registration. Furthermore, there were concerns that a lack of knowledge regarding regulations and administrative responsibilities could impact the sustainability of customary territories and community participation in the implementation of customary land registration. Therefore, the implementation of customary land registration requires improvement through a more participatory, transparent approach, and an emphasis on the cultural principles governed by customary law. Therefore, the fundamental goal of customary land registration is not merely the legalization of administrative rights, but must truly guarantee the protection of indigenous peoples' rights and the comprehensive protection of customary land and the sustainability of customary territories.
