Abstract

Waqf land certification in Indonesia continues to face significant structural challenges. Data from the Ministry of Religious Affairs’ Waqf Information System (SIWAK) indicate that only 57.42% of waqf land has been formally certified nationwide. In Surabaya, 904 out of 1,509 waqf land parcels, covering 63.44 hectares, remain uncertified. In response, the Surabaya II Land Office initiated the Waqf Land Certification Acceleration Program as a strategic effort to strengthen legal certainty over religious assets. This study aims to analyze the implementation mechanism, assess its effectiveness, identify key obstacles, and examine the improvement strategies developed within the program. This research employs a qualitative approach using in-depth interviews, document analysis, and literature review. Data were collected from ten informants representing eight institutions. Data analysis was conducted through source and method triangulation, applying the theoretical frameworks of Legal Effectiveness by Soerjono Soekanto (1983), Policy Implementation by George C. Edward III (1980), and the Collaborative Governance approach. The findings reveal that the program has generated several progressive innovations, including pre-measurement initiatives, the first mass waqf pledge (Ikrar Wakaf Massal) in Indonesia, and the establishment of a cross-institutional task force. From the legal effectiveness perspective, the program is categorized as moderately effective, with four out of five factors assessed as sufficiently effective, while the legal culture factor remains ineffective. From the policy implementation perspective, all variables are categorized as implemented with constraints, primarily due to institutional fragmentation, disparities in human resource capacity, instability of the e-AIW digital system, and the absence of a binding Mayor Regulation. This study recommends strengthening institutional arrangements through formalization of innovations into standard operating procedures, the issuance of binding local regulations, capacity building for implementing actors, improved funding mechanisms, and policy harmonization across institutions. The findings underscore that the effectiveness of the program depends not only on institutional capacity but also on cross-sectoral policy integration and the long-term transformation of legal culture.
