Abstract

The problem of settlement land tenure within forest areas creates legal uncertainty and tenurial conflicts, as occurs in Deaga Village, South Bolaang Mongondow Regency. Based on the Decree of the Minister of Forestry No. 734/Menhut-II/2014, most of the village's settlement areas fall within forest zones, although the community has occupied and utilized the land for generations since 1980. This study aims to: (1) identify the characteristics and spatial distribution of settlement land tenure within forest areas; (2) assess the conformity of land tenure with resolution criteria under Government Regulation No. 23 of 2021 and Minister of Environment and Forestry Regulation No. 7 of 2021; and (3) formulate recommended resolution patterns. The research employs a qualitative method with a spatial approach, including satellite image digitization, forest area map overlay, Nearest Neighbor pattern analysis, field observation, in-depth interviews covering 143 settlement land parcels, and documentation study of relevant regulations and policies. The results show that Deaga Village has a total settlement area of 6.2 hectares, with 5.8 hectares (93.07%) located inside the forest area, exhibiting a clustered settlement pattern divided into two locations by the Deaga River. The P4T inventory identified 143 land parcels, consisting of 136 parcels controlled by individuals and 8 parcels by government institutions. All land parcels fulfill the five criteria for forest area land tenure resolution under Article 132 of Minister of Environment and Forestry Regulation No. 7 of 2021, namely: tenure established before the enactment of the Job Creation Law (1980–2010 period); continuous tenure for a minimum of 5 years (15–46 years); individual tenure area not exceeding 5 hectares (maximum 1,576 m²); tenure conducted in good faith and openly (evidenced by land and building tax payments and appropriate land use); and the absence of disputes. Additionally, one certified land parcel (Certificate of Ownership No. 1/2019) was also found to be located within the forest area. The study concludes that the recommended resolution pattern is through the mechanism of Settlement of Land Tenure within the Framework of Forest Area Arrangement (PPTPKH) with the scheme of changing forest area designation to Other Use Areas (APL), subsequently designated as Land Objects of Agrarian Reform (TORA). This recommendation is based on Deaga Village's inclusion in the 2024 Indicative PPTPKH Map with an allocation of 9.35 hectares, the adequacy of forest area in South Bolaang Mongondow Regency (74.56%), and the socialization conducted by the Inventory Team of Regional Forest Area Stabilization Agency (BPKH) Region VI in February 2026. For certified land parcels, resolution follows Typology I (certificate issuance prior to forest area designation) through the mechanism of releasing rights from the forest area. Successful implementation of these recommendations requires strengthened coordination of the Task Force for Agrarian Reform (GTRA) of South Bolaang Mongondow Regency, assistance to the community in completing administrative documents, and active community participation.
