Abstract
The construction of the Jogja–Bawen Toll Road is an infrastructure development project that requires land acquisition for public interest. In its implementation, the project has resulted in remaining land in Pingit Village and Kebumen Village, Pringsurat Subdistrict, Temanggung Regency, because several land parcels were only partially affected by the toll road alignment. This study aims to: (1) identify the process of settling remaining land in the Jogja–Bawen Toll Road land acquisition; and (2) analyze its conformity with Minister of Agrarian Affairs and Spatial Planning/National Land Agency Regulation Number 19 of 2021. This research used a qualitative descriptive method of legal approach. Data were collected through interviews, field observations, and documentation studies. Interviews were conducted with relevant informants involved in the land acquisition process, while field observations were used to examine the factual condition of the remaining land. Documentation studies were carried out by analyzing land acquisition documents, remaining land assessment reports, maps, regulations, and other supporting documents related to the settlement of remaining land in Pingit Village and Kebumen Village. The results show that the settlement process was carried out through applications from entitled parties, field surveys, analysis of remaining land, and preparation of assessment results in official minutes. The study found that five parcels were recommended for compensation, while fifty-three parcels were not recommended because they were still considered usable in terms of shape, function, and access. A key finding is that remaining land with an area of less than 100 m² was still included in the assessment process, although the regulation states that such land may be compensated if it can no longer be used. This indicates that the implementation was not fully in accordance with the regulation, particularly regarding the treatment of remaining land below 100 m².
