Abstract

This research is grounded in the preparation of the Land Acquisition Planning Document (DPPT) in the implementation of land acquisition for development in the public interest, both large-scale (land area exceeding five hectares) and small-scale (less than five hectares), as regulated under Law Number 2 of 2012 concerning Land Acquisition for Development in the Public Interest, Government Regulation Number 19 of 2021 concerning the Implementation of Land Acquisition for Development in the Public Interest as amended by Government Regulation Number 39 of 2023, and Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 19 of 2021 as its implementing regulation. The DPPT functions to ensure the integration of land acquisition with spatial planning, development priorities/the Regional Medium-Term Development Plan (RPJMD), budget readiness, and the development timeline. In the context of Parigi Moutong Regency, the process of land acquisition has not fully complied with the prevailing laws and regulations on land acquisition, thereby affecting the effectiveness of land utilization after acquisition carried out without the support of a DPPT—this forms the basis of the urgency of this study. This research aims to analyze the process, impacts, and handling strategies related to small-scale land acquisitions carried out by the Parigi Moutong Regency Government from 2021 to 2022 without a DPPT. This research employs a descriptive qualitative approach, selecting one sample from the research population, namely the land acquisition for the development of the Marine and Fisheries Polytechnic in Poly Village, South Tinombo District, covering an area of 2.5 hectares, which was acquired in 2021 but, as of 2026, remains unutilized for any development consistent with the original purpose of the acquisition. The research findings show that the process was not based on a DPPT, was not equipped with a Conformity of Spatial Utilization Activity (KKPR), was not aligned with the RPJMD or the Strategic Plan (Renstra) of the relevant Regional Apparatus Organization (OPD), and that, under the spatial pattern zoning regulations, the construction of a marine and fisheries education building is not permitted. In addition, the results of the land acquisition were never registered to establish a regional asset land right at the Land Office, so the land status remains recorded as community-owned property. The absence of a DPPT has resulted in the ineffective utilization of the acquired land, legal uncertainty, and regional budget inefficiency. The root causes are systemic in nature, namely top-down decision-making based on verbal instructions from leadership, weak coordination across OPD and government institutions, and miscommunication regarding development programs funded by the State Budget (APBN) and RPJMD priorities. The main recommendations include strengthening the DPPT as a mandatory prerequisite prior to budgeting for land acquisition, improving cross-institutional coordination at the regional level between the Regency Government, the Land Office, and relevant OPD, and developing a post-acquisition monitoring mechanism.
