Abstract

This study aims to analyze the primogeniture system and the position of the eldest daughter in the Yaghai Tribe of Mappi Regency, South Papua Province. Primogeniture is a system of inheritance and family succession that grants primary rights to the firstborn child. This research employs an empirical legal research method with a qualitative approach. Data were collected through interviews, observations, and document analysis involving customary leaders, indigenous community members, and other relevant stakeholders. The findings reveal that the primogeniture system remains an integral part of the Yaghai customary law, regulating family relations, inheritance, and social responsibilities. The eldest daughter holds an important position within the family, particularly in maintaining kinship relations, assisting in family caregiving, and preserving customary values and traditions. However, in certain aspects, such as ownership and control of specific customary rights, male family members continue to play a dominant role. Therefore, the position of the eldest daughter in the Yaghai Tribe reflects a combination of recognition of women's roles and the persistence of patriarchal customary norms. This study is expected to contribute to the development of customary law studies and the protection of women's rights within indigenous communities.
