Abstract
The land movement event that occurred in 2025 in Mendala Village, Sirampog District, Brebes Regency caused physical changes to land parcels, including ground cracks, subsidence, displacement, and bulging, affecting the shape, position, area, and boundaries of land parcels. These changes potentially create technical and legal issues in the implementation of land registration. This study aims to analyze the physical condition of land parcels after the land movement event, examine the status of land rights and legal protection for right holders, and formulate technical and legal recommendations for the affected area. This study employed a qualitative method with an empirical juridical approach. Data were collected through field observations, interviews with affected communities and relevant institutions, and document reviews. Data were analyzed using the Miles and Huberman model. Technical analysis was conducted through zoning based on the degree of land parcel changes, while juridical analysis was carried out in accordance with Indonesian land laws and regulations. The results indicate that the physical changes to land parcels can be classified into three zones: Zone I (minor changes), Zone II (moderate changes), and Zone III (major changes). In Zones I and II, land parcels remain identifiable, allowing boundary re-establishment to be carried out, whereas in Zone III boundary re-establishment is not feasible due to significant physical changes. From a juridical perspective, the land movement event generally does not extinguish land rights because the land parcels remain identifiable and usable. However, the physical changes have resulted in discrepancies between cadastral records and actual field conditions, thereby weakening legal certainty regarding land rights. In addition, some areas were identified as potentially meeting the criteria for destroyed land and therefore require further inventory and verification by the Land Office. This study recommends inventorying the affected area, conducting resurveying, boundary re-establishment, and updating cadastral data to restore legal certainty over land rights in post-disaster areas.
