Abstract

Partial waqf land is a form of waqf that covers only a portion of a land parcel, while the remainder remains privately owned. This situation often gives rise to administrative, legal, and social issues, particularly regarding land subdivision, boundary demarcation, and the issuance of waqf land certificates. This study aims to analyze the registration mechanism for partial waqf land, identify the obstacles encountered, and formulate resolution strategies in Kediri Regency. The study is qualitative in nature, employing a sociological legal method with a case study approach. Data were collected through interviews, observations, and document analysis. The findings indicate that the registration of partial waqf land must begin with the subdivision of the land parcel prior to the execution of the Waqf Declaration Deed and the issuance of the waqf land certificate. Major challenges include unclear land boundaries, insufficient administrative documentation, differing perceptions among stakeholders, and low public awareness regarding the importance of waqf certification. Resolution efforts are carried out through interagency coordination, field validation, deliberation, digitization of waqf administration services, and capacity building for waqf trustees. Collaborative governance among related institutions plays a critical role in strengthening legal certainty and ensuring the sustainable management of waqf assets.
