Abstract

Land disputes involving the illegal issuance of land title certificates are a recurring legal problem in Indonesia's land administration system. This study examines the cancellation of Land Title Certificate Number 40/Muktiwari Village in the name of Hendra Muslim, issued by the Bekasi Regency Land Office in 1998 for land previously registered in the name of the late Hj. Djubaidah Binti H. Hasan, and the mechanism for implementing the cancellation following a final and binding court decision. This study aims to determine the chronology of the land dispute that led to the issuance of the State Administrative Court Decision Number 46/G/2023/PTUN.BDG in conjunction with the High State Administrative Court Decision Number 303/B/2023/PT.TUN.JKT. To understand the mechanism for revoking land title certificates by the Bekasi Regency Land Office and the West Java Province National Land Agency Regional Office as a follow-up to implementing legally binding court decisions. To understand the obstacles that arise and the solutions implemented by the Bekasi Regency Land Office and the West Java Province National Land Agency Regional Office in revoking land title certificates based on legally binding court decisions. This research uses a normative-empirical legal method with a case study approach, supported by secondary data consisting of court decisions, documents requesting the cancellation of land title certificates from the Bekasi Regency Land Office, and related laws and regulations. Primary data was obtained through interviews with officials from the Bekasi Regency Land Office and the West Java Province National Land Agency Regional Office. The results of this study indicate that the issuance of Land Title Certificate Number 40/Muktiwari Village was legally flawed, stemming from two procedural irregularities: an application for a replacement certificate submitted by a party with no legal relationship to the land, and registration of the transfer of rights based on a sale and purchase deed that was reported lost, resulting in both the Bandung State Administrative Court and the Jakarta High Administrative Court consistently supporting the heirs' claims. Post-decision cancellation was carried out through a series of step-by-step procedures, including case review, field research, research exposure, final title, issuance of a Cancellation Decree by the West Java Provincial National Land Agency Regional Office, and recording in the land register by the Bekasi Regency Land Office. Obstacles encountered included incomplete administrative documents submitted by the applicant and internal archive management challenges, which were addressed through improved archive management, strengthened coordination between units, and proactive official communication to inform applicants of missing document requirements.
