Abstract
Land Consolidation on nagari customary land has different characteristics from Land Consolidation on individually held land because the community had occupied and utilized the land without possessing individual land rights, while authority over the land remained with the customary law community through the Nagari Customary Council and ninik mamak. This study aims to analyze the Land Consolidation process, the arrangement of land tenure and rights, and the form of Land for Development on nagari customary land in Pauh Barat Village, Pariaman City. This study employed a qualitative method with a descriptive approach. Data were collected through interviews, field observations, and document analysis and were analyzed through data collection, data reduction, data presentation, and conclusion drawing and verification. The findings show that Land Consolidation was implemented through the stages of planning, implementation, development of results, and supervision, with adjustments to the characteristics of customary land, particularly through the involvement of the Nagari Customary Council and ninik mamak in granting approval, determining participants, and regulating land utilization. The arrangement resulted in a Right of Management held by the Nagari Customary Council as the underlying right and Rights of Use granted to 60 participants over the rearranged parcels. This arrangement did not constitute a conversion from Ownership Rights into Rights of Use because the participants had not previously held individual land rights. Land for Development originated from a portion of the customary land within the Right of Management area and was allocated for roads and neighborhood infrastructure. The Land for Development was granted under a Right of Use to the Pauh Barat Village Government to be managed as a village asset for as long as it is used for public purposes. The resulting empirical pattern demonstrates that Land Consolidation on nagari customary land requires the integration of customary authority, land administration, participant agreement, infrastructure development, and supervision of the rearranged area.
