Abstract

This study aims to analyze the issuance process of the Spatial Utilization Activity Suitability Approval (PKKPR), evaluate the effectiveness of spatial utilization control, and identify the potential social and environmental impacts of a 22.5-hectare real estate development planned by PT Stasionkota Sarana Permai in Pecalukan Village, Prigen District, Pasuruan Regency, a landslide-prone area on the slopes of Mount Arjuno. This research employed a qualitative descriptive-analytical approach with a case study strategy. Data were collected through in-depth interviews with the Land Office, Spatial Planning Agency, Regional House of Representatives' Special Committee, and affected communities, supported by policy documents, Land Technical Consideration (PTP), PKKPR documents, and Geographic Information System (GIS)-based spatial analysis. The effectiveness of spatial utilization control was analyzed using Yunus' (2008) framework of regulation, monitoring, and enforcement The results show that the PKKPR issuance complied procedurally with Government Regulation No. 21 of 2021 and Minister of ATR/BPN Regulation No. 13 of 2021, but the verification process emphasized administrative compliance rather than substantive risk assessment. This is indicated by the absence of a new PKKPR application following the change from nature tourism to real estate development and the lack of an Environmental Impact Assessment (AMDAL), although about 50% of the site has slopes exceeding 25%. The regulatory subsystem operated procedurally but was substantively weak, while the monitoring and enforcement subsystems were ineffective. Consequently, spatial control relied more on community pressure and recommendations from the Regional House of Representatives' Special Committee than on formal government oversight. The proposed development has the potential to increase the risks of landslides and flash floods, reduce groundwater recharge capacity, worsen the regional groundwater deficit, and generate spatial conflicts and social injustice arising from the unequal distribution of development benefits and environmental risks. This study recommends strengthening cross-sectoral coordination, implementing substantive risk-based evaluation within the licensing process, and enhancing meaningful public participation from the earliest stages of planning to support sustainable development.
