Abstract

The administration of customary lands is a critical issue in land governance because it brings together the state’s mandate to recognize indigenous communities and the need to protect communal rights that are rooted in local social and cultural systems. This study examines the administration of customary lands among the Karo Indigenous Community in Ngada Regency, East Nusa Tenggara Province, in the context of the implementation of Ministerial Regulation ATR/BPN No. 14 of 2024 on the administration of land and the registration of customary land rights of indigenous communities. The research problem stems from the gap between the normative recognition of customary land rights and the reality of implementation on the ground, primarily because the administration of customary land is not merely understood as a technical activity of land parcel registration but is also intertwined with historical origins, customary institutions, rituals, customary legal frameworks, local knowledge, and the aspirations of the community as the rights holders. This study aims to evaluate the extent to which customary land inventory data accommodates the history, traditions, culture, and customary legal institutions of the Karo Customary Law Community; to analyze the forms of community involvement in the demarcation, measurement, and mapping of customary land parcels; to identify community perceptions and aspirations regarding the urgency of administering and registering customary land; and to examine the benefits of the Customary Land Register for local governments in formulating policies for the recognition of indigenous communities. This study employs a qualitative method using a rapid ethnography approach. Data were collected through participatory observation, in-depth interviews, documentation, and document analysis. Interviews were conducted with traditional leaders, community members, women and youth leaders, the Were IV Village Government, the Ngada Regency Government, the Ngada Regency Land Office, and supporting institutions. Analysis was conducted through data reduction, data presentation, drawing conclusions, and verification, all from the community’s emic perspective. The research findings indicate that the administration of the MHA Karo customary lands has taken into account ancestral history, the sa’o structure, customary institutions, rituals, customary artifacts, customary boundary markers, as well as patterns of control and use of customary lands, although some of the data is still based on the memories and oral traditions of customary elders. The boundary-delimitation and mapping processes took place in a participatory manner through customary deliberations, the consent of neighboring parties, and the involvement of customary leaders, youth, and women. The community accepts the Customary Land Register (DTU) as a form of administrative recognition that strengthens the legitimacy of customary territories, but remains cautious about subsequent registration through Management Rights due to concerns that it may reduce customary authority and shift the communal significance of customary lands. This study concludes that the administration of customary lands is an initial step toward protecting customary rights, not an end in itself; therefore, it must be followed up through local regulations, coordination between the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) and local governments, as well as participatory administration models that ensure the sustainability of customary law communities.
