Abstract

The construction of the Ulumbu Geothermal Power Plant (PLTP) Access Road in Wewo and Ponggeok Villages, Manggarai Regency, crosses community agricultural and plantation lands with mountainous topography. During the land acquisition process, discrepancies in land area are frequently found between the Land Acquisition Planning Document (DPPT) and the actual measurements conducted by Task Force A (Satgas A) during the implementation phase.This study aims to identify and synthesize the main factors causing these land area discrepancies using a qualitative method with an empirical and normative juridical approach (Mixed Approach). Data were filtered and synthesized from interviews (Head of Office, Section Head of Survey and Mapping, Task Force A), field observations, and land regulations (PMNA No. 3/1997 and Permen ATR/BPN No. 16/2021). The analysis reveals three main clusters of causes for the area discrepancies: 1. A methodological shift from 2D flat projection based on medium-resolution satellite imagery in the DPPT to high-precision terrestrial methods using GNSS by Task Force A, alongside land cover constraints (multipath) and historical error corrections from old certificates measured using manual tape. 2. A gap in pre-measurement readiness as regulated by Article 79 of PMNA No. 3/1997, specifically the uncertainty of Technical Reference Points (TDT) on old certificates. 3. The dynamic application of the contradictoire delimitatie principle (boundary agreement with neighbors) when Task Force A deployed to the field, landowners' negligence in maintaining boundary markers, and physical changes to the land caused by prior infrastructure development. The land area discrepancies in this project are not mathematical errors, but rather the result of increased accuracy from modern measuring instruments and the dynamics of legalistic boundary determination on-site, as agreed upon by the neighboring landowners.
