Abstract

The transfer of land rights involving non-indigenous Indonesian citizens in the Special Region of Yogyakarta is subject to a distinctive land policy under the Instruction of the Deputy Head of the Special Region of Yogyakarta Number K.898/I/A/1975, which requires the relinquishment of land ownership rights. This policy affects the administrative actions of the Land Office and may give rise to legal disputes. This study aims to analyze the administrative actions of the Kulon Progo Land Office in the transfer of land rights involving non-indigenous Indonesian citizens, examine the judges’ legal considerations in Decision Number 136/Pdt.G/2023/PN Yyk juncto Number 86/PDT/2s024/PT Yyk, and identify its implications for land administration services. The research employed an empirical juridical method with a qualitative approach through interviews, document studies, and literature reviews. The findings indicate that the Kulon Progo Land Office implements the land rights relinquishment mechanism in accordance with the land policy applicable in Yogyakarta. The court held that the dispute concerned administrative actions of government officials and therefore fell outside the jurisdiction of the general courts. This study concludes that the administrative actions undertaken were consistent with the applicable land policy and that the court decision provides greater certainty regarding dispute resolution authority and the implementation of land administration services.
