Abstract

Land is a resource that has a significant meaning in people's lives, both from an economic, social, and legal perspective. In order to guarantee legal certainty over land control and ownership, the government organizes land registration as evidenced by the issuance of land title certificates. However, these certificates can be revoked if there are administrative or legal defects found in the issuance or transfer of rights. This study aims to examine the cancellation mechanism for Land Title Certificate Number 1675/Jelambar Baru at the West Jakarta City Administration Land Office, identify obstacles that arise during the implementation process, and analyze efforts made to overcome these obstacles. This study applies an empirical legal research method through a qualitative approach. Data were obtained through interviews, documentation studies, field observations, and analysis of laws and regulations relevant to the cancellation of land title certificates. The research focuses on Case Number 556/Pid.B/2021/PN.Jkt.Brt, which indicates the use of false identities and documents in the land title transfer process. Research findings indicate that the certificate cancellation process involves an application, physical and legal data examination, case review, and case title, before the cancellation decision is issued by the authorized official. Several obstacles encountered include the lack of a clear deadline for completion, the applicant not yet physically possessing the land object, the existence of a counterclaim, and the failure to submit a report on the execution of the land. In an effort to overcome these problems, the Land Office, together with the BPN Regional Office, conducted field research, as well as ensuring legal certainty and preventing further transfer of rights.
