Abstract
The increasing public demand for land in urban areas often triggers structural imbalances, leading to conflicts of interest between local communities and State- Owned Enterprises (SOEs). This study aims to examine the chronology, contributing factors, and alternative dispute resolutions regarding the agrarian conflict over the unilateral claim of state asset land control derived from former Eigendom Verponding Number 1278 covering an area of ±220.4 hectares in Surabaya City between the community and PT Pertamina (Persero). The research method applied is qualitative with a descriptive normative-juridical approach. Data were gathered through observation, interviews, and documentation of physical and legal data across four sub- districts within three sub-districts in Surabaya City. The results indicate that the conflict's chronology stems from the post-independence nationalization policy of foreign corporate assets belonging to Bataafsche Petroleum Maatschappij (BPM), which were later transferred to Pertamina. The tension escalated when PT Pertamina (Persero) submitted an objection letter on June 16, 2023, to the Surabaya City Land Office I, asserting its legal ownership based on an unconverted old land title. This action led to a unilateral suspension and blocking of land administration services since 2010, disadvantaging the local community. As a solution, non-litigation dispute resolution can be pursued by utilizing legal instruments under Law No. 1 of 2004 concerning the State Treasury and Presidential Regulation No. 62 of 2023 concerning the Acceleration of Agrarian Reform. The recommended alternative solutions involve asset utilization cooperation schemes or granting Building Use Rights (HGB) over the SOE's Land Management Rights (HPL). This scheme is deemed capable of delivering legal certainty and social justice by preserving the state asset status while simultaneously legitimizing the living space rights of the affected community.
