Abstract

The land tenure dispute over PT Kereta Api Indonesia (Persero) Regional Operational 6 Yogyakarta assets with the community in Bausasran Village, Danurejan District, Yogyakarta City, arose due to long-term occupation of the former PT KAI official housing complex situated on Sultan Ground belonging to the Ngayogyakarta Hadiningrat Sultanate. The land was entrusted to PT KAI through Serat Palilah. The community claims physical tenure rights based on the Land Certificate (SKT) and hereditary occupancy history, while PT KAI maintains its right to manage state assets based on historical Grondkaart documents and national land law provisions. This study aims to analyze the legal status and history of land tenure as well as to formulate effective and equitable dispute resolution measures. This research employs a juridical-empirical approach with a qualitative method. Primary data were obtained through in-depth interviews with various relevant informants, field observations, and official document studies. Meanwhile, secondary data were collected from statutory regulations, scientific literature, and other related official documents. Data analysis was conducted qualitatively using deductive and comparative approaches, combining normative juridical and sociological legal analysis to reveal legal facts and social realities in the field. The research findings indicate that the disputed land is a PT KAI asset with the status of Sultan Ground, which is temporarily authorized through Serat Palilah. The resolution efforts undertaken by PT KAI included socialization, deliberation, compensation payments, gradual warning letters, and forced eviction on July 8, 2025, involving regional coordination with relevant authorities. This study concludes that dispute resolution requires a balance between law enforcement and a humane approach based on local culture. Synergy among PT KAI, the Ngayogyakarta Hadiningrat Sultanate, local government, and the community is the key to preventing similar disputes while supporting the optimization of railway assets and social justice.
