Abstract

The conflict over land tenure of the former Right to Use (HGU) of PT. Trisno Kenangan in Lantan Village, North Batukliang District, Central Lombok Regency occurred due to a difference in claims between the cultivating community and the company for the land used by HGU which has expired. After the HGU ended, the community began to control and utilize the land as agricultural land and a source of livelihood, while the company continued to base its claims on the history of rights and civil court decisions. The difference of views on the legal status of the land then developed into a land conflict that has lasted since the community began to control the land around 2007-2009 and continues until 2026, so it has lasted approximately 17-19 years. In its development, the conflict experienced a peak of conflict marked by an increase in community demonstrations in the 2022-2024 period, because the parties still maintained their respective claims despite various settlement efforts. Based on its characteristics, this conflict includes a typology of land tenure and ownership conflicts triggered by differences in claims to the legal status of ex-HGU land. This study aims to find out the history of land acquisition and control that is the background of the conflict of land tenure of the former HGU of PT. Trisno Kenangan and analyzed the conflict resolution efforts carried out by the National Land Agency (BPN). The research subjects consist of the Lantan Village cultivating community, the Central Lombok Regency Land Office (BPN), the Lantan Village Government, and the Agrarian Reform Task Force (GTRA) as parties involved in the conflict resolution process. This research uses empirical legal research methods that are descriptive. Data were obtained through interviews with related parties, field observations, and literature studies on primary, secondary, and tertiary legal materials. The collected data is then analyzed in a qualitative descriptive manner to obtain an overview of the chronology of conflicts and efforts to resolve them. The results of the study show that the conflict began with the end of the HGU without any clarity on the status of land use after the expiration of the right. Differences in interpretation of the legal status of land between communities and companies are the main factors that trigger conflicts. Settlement efforts have been carried out through mediation and facilitation by BPN through the agrarian reform approach involving the Agrarian Reform Task Force (GTRA). The settlement scheme accommodates the interests of the community, local governments, and ex- rights holders through the distribution of land proportions which is expected to provide certainty of land rights and minimize the potential for sustainable conflicts.
