Abstract

The issuance of land title certificates aims to provide legal certainty and legal protection for land rights holders. However, in practice, the issuance of duplicate land certificates remains a significant issue that often leads to land disputes. One such case is reflected in the Decision of the Semarang Administrative Court Number 88/G/2024/PTUN.SMG concerning the issuance of a duplicate Certificate of Ownership (SHM) Number 5199/Gedong through the Complete Systematic Land Registration (PTSL) program. This study aims to examine the chronology of the issuance of the duplicate certificate, analyze the factors contributing to its occurrence, and assess the implementation of the Administrative Court's decision by the Karanganyar Land Office. This study employs a normative juridical research method using statute approach. Data were collected through a literature review of laws and regulations, court decisions, and supported by primary data obtained from interviews with officials of the Karanganyar Land Office. The data were analyzed by examining legal facts, statutory provisions, and interview findings. The results indicate that the duplicate certificate resulted from the issuance of Certificate of Ownership (SHM) Number 5199/Gedong under the PTSL program on a portion of land that had previously been registered as Certificate of Ownership (SHM) Number 1909/Gedong. The occurrence of the duplicate certificate was influenced by both internal and external factors. Based on the Decision of the Semarang Administrative Court Number 88/G/2024/PTUN.SMG, Certificate of Ownership (SHM) Number 5199/Gedong was declared null and void. Subsequently, the Karanganyar Land Office followed up the decision by proposing the cancellation of the legal product to the Regional Office of the National Land Agency of Central Java Province in accordance with the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 21 of 2020. This study highlights the importance of improving accuracy in land registration procedures, verifying both physical and juridical data, and updating the land administration database to prevent the recurrence of duplicate land certificates.
