Abstract
Land title overlap is one of the major land administration problems that may lead to legal uncertainty, land tenure conflicts, and disputes over land rights. The overlap case involving Ownership Rights Certificates (Sertipikat Hak Milik/SHM) Nos. 258, 272, 284, and 285 and several Building Use Rights Certificates (Hak Guna Bangunan/HGB) owned by PT. A and PT. B in Citeras Village, Rangkasbitung District, Lebak Regency, Banten Province demonstrates that the implementation of legal certainty principles in land registration still faces various challenges. This study aims to analyze the factors causing certificate overlap and to examine the settlement efforts and effectiveness of dispute resolution undertaken by the Lebak Regency Land Office. This research employed a qualitative method with a descriptive approach. Data were collected through interviews, observations, document reviews, and examination of physical and juridical land records related to the disputed parcels. Data analysis was conducted through data reduction, data presentation, and conclusion drawing. The findings reveal that certificate overlap was primarily caused by land administration factors and technical factors related to surveying and mapping. The most dominant factor was the technical aspect, particularly the absence of older land parcels in the electronic cadastral mapping system, the use of local coordinate systems in older certificates, and limitations in spatial data during the issuance of land rights. Meanwhile, legal and social factors were not found to be the primary causes of the overlap in this case. The dispute resolution process was carried out through complaint handling, examination of physical and juridical data, field surveys and verification, mediation between the parties, and the establishment of a formal settlement agreement documented in a peace deed. The resolution process was considered relatively effective because it provided legal certainty, clarified land parcel boundaries for most disputed areas, and gained acceptance from the parties involved, although several disputed parcels still require further settlement measures..
