Abstract
This research was motivated by the persistently high levels of inequality in land tenure and the increasing number of agrarian conflicts in Indonesia, particularly in areas that are legally designated as forest areas but have, in fact, long been inhabited and utilized by local communities. These conditions create legal uncertainty and highlight a disparity between the designation of forest areas and the reality of land tenure on the ground. The government has established various policies, including the Settlement of Land Tenure in Forest Areas (PPTPKH) and Agrarian Reform, to promote the resolution of land tenure issues and designate such lands as Agrarian Reform Land (TORA). However, their implementation still faces various obstacles at the field level. This study aims to analyze patterns of land tenure, use, and utilization by communities within forest areas; identify factors that support and hinder the implementation of land tenure resolution; and analyze the resolution mechanism through the PPTPKH as the basis for the provision of TORA in Dua Koran Village, Belu Regency. The method used was qualitative research with a descriptive approach. Data were collected through observation, interviews, and document analysis, and then analyzed using qualitative descriptive methods. The research findings indicate that land tenure by the community in Dua Koran Village has existed for a long time and is largely hereditary. The land is primarily used for agriculture and settlements, which serve as the community’s main source of livelihood. Although some forest areas have been released and land redistributed, there are still plots of land that have been controlled and utilized by the community but have not yet been released from forest area status, and thus lack legal certainty. The implementation of land tenure resolution is influenced by supporting factors such as the duration of land tenure, government policy support, and community participation, while inhibiting factors include limited data integration, suboptimal public outreach, and inter-agency coordination that still faces challenges. The PPTPKH mechanism, through the adjustment of forest area boundaries, is considered the most relevant in the context of this study as the basis for providing TORA in the region. These findings illustrate that there remains a gap between long-standing community land tenure patterns and forest area release policies; therefore, the implementation of the PPTPKH must continue to be optimized to support agrarian reform.
