Abstract

Based on historical records, the King of Buleleng granted land to the Patih of Blambangan as a reward for his service and dedication. The land was subsequently possessed and inherited from generation to generation by his heirs and has been utilized for residential areas, places of worship, cemeteries, educational facilities, and other public facilities. In accordance with Article 19 of Law Number 5 of 1960 concerning the Basic Agrarian Principles (Basic Agrarian Law/UUPA), every parcel of land must be registered to ensure legal certainty. However, a number of land parcels originating from the King's grant remain uncertified. This study aims to analyze the legal status of the former royal grant land of the King of Buleleng and the process of its land certification. This research employed a qualitative method with a case study approach. Data were collected through field observations, interviews, and document studies related to the history of land tenure, customary law, and land regulations. The collected data were analyzed using qualitative data analysis techniques, including data reduction, data presentation, and conclusion drawing. The results indicate that the former royal grant land constitutes individually held customary land granted by the King of Buleleng to the Patih of Blambangan in 1711, which has since been continuously possessed and inherited by his heirs. Based on its history of acquisition, the land is not classified as former swapraja land because ownership had been fully transferred to an individual long before the enactment of the Basic Agrarian Law. The land certification process was carried out through the National Agrarian Program (PRONA) in 2013 using the rights conversion mechanism stipulated in Article II of the Transitional Conversion Provisions of the Basic Agrarian Law. The conversion was based on historical evidence, continuous physical possession across generations, and supporting evidence confirming land tenure, resulting in the issuance of land certificates as a form of legal recognition, legal certainty, and legal protection for the rights holders.
