Abstract

A flash flood in Rua Urban Village, Ternate Island District, Ternate City, caused various land-related issues—such as altered land parcel boundaries, lost ownership documents, and uncertain land tenure status—prompting the government to implement a relocation program to safer areas. This relocation requires a clear legal basis, compliance with statutory regulations, and an active role from the Land Office to ensure legal certainty regarding the land rights of affected residents. This study aims to analyze the legal basis for relocation within the context of disaster management, examine the relocation process's compliance with applicable regulations, and explain the Land Office's role in resolving land issues arising from the relocation of residents affected by the flash flood in Rua. The study employs a qualitative method with a descriptive-analytical approach. Data were gathered through interviews, field observations, and document reviews, then analyzed qualitatively through data reduction, data presentation, and conclusion drawing. The results indicate that the relocation was based on various laws and regulations governing disaster management, land affairs, spatial planning, and housing provision. The relocation process was generally carried out in accordance with applicable provisions—encompassing the registration of affected residents, site selection, land provision, and the construction of permanent housing—although challenges remained regarding land administration, land tenure status certainty, and the finalization of land documents. The Ternate City Land Office played a crucial role through land surveying and mapping, land status determination, the issuance of land title certificates, and coordination with local government to prevent land disputes and provide legal certainty for relocated residents. Thus, the successful resolution of land issues resulting from relocation depends not only on regulatory compliance but also on inter-institutional synergy in ensuring legal certainty and protecting land rights for disaster-affected communities.
