Abstract
Public Infrastructure, Facilities, and Utilities (Prasarana, Sarana, dan Utilitas Umum PSU) are essential facilities that developers are required to provide and transfer to local governments to ensure the quality of residential environments and the sustainability of public services. However, the implementation of PSU provision and transfer in Semarang City continues to face various challenges, including the low rate of PSU transfer, non- conformity between development and the City Planning Information (Keterangan Rencana Kota – KRK), unclear authority for inter-agency supervision, and legal issues concerning PSU land status. This study aims to analyze the implementation of PSU provision and transfer, as well as the factors influencing its implementation in Semarang City. This study employed an empirical legal research method using a qualitative approach. Data were collected through interviews, field observations, and document analysis involving the Regional Development Planning Agency (BAPPEDA), the Housing and Settlement Agency (Disperkim), the Spatial Planning Agency (Distaru), the Semarang City Land Office, and residents of four residential housing estates. The data were analyzed descriptively using the policy implementation theory developed by Donald Van Meter and Carl Van Horn. The findings indicate that the implementation of PSU provision and transfer has not yet been optimal. In general, PSU provision has referred to the KRK; however, discrepancies in implementation remain due to weak supervision and inter-agency coordination. Of approximately 400 recorded housing estates, only about 100 estates (25%) have transferred their PSU to the Semarang City Government. The main obstacles include unclear supervisory authority between Distaru and Disperkim, low developer compliance, legal issues related to PSU land, and the large number of older housing estates whose developers are no longer active. The study also found a shift in the role of the community, with residents taking the initiative in facilitating PSU transfers, indicating that policy implementation has evolved toward a more collaborative governance model.
