Abstract

This study analyzes the application of the General Principles of Good Governance in the recording of land title transfers by the National Land Agency in PTUN Surabaya Decision No. 240/G/2022/PTUN.SBY. The main issue examined is whether the issuance of the land certificate transfer complied with the principles of legal certainty, accuracy, transparency, impartiality, and good service. This research aims to assess the implementation of these principles, identify any administrative violations, and examine the legal consequences and legal remedies available to the aggrieved party. The method used is descriptive qualitative research with a juridical-empirical approach through document analysis, court decision review, and relevant field data. The findings show that the National Land Agency had examined the APHB document, inheritance statement, land book data, and the status of blockage and seizure before processing the application. At the time of submission, there was no official record of blockage, seizure, or dispute notification in the land administration system. Therefore, the Agency’s action was considered administratively valid, although there was a different assessment by the court regarding substantive prudence. This study concludes that the legality of administrative action in land administration must be assessed based on authority, procedure, and the official data available when the decision was made.
