Abstract
This study examines the process of ulayat land certification as a form of legal protection for indigenous peoples’ rights, with a case study of ulayat land certification through the Integrated Land Administration and Spatial Planning Project (ILASPP) in Tandula Jangga Village, Nggaha Ori Angu District, East Sumba Regency. Ulayat land is a communal land tenure system that holds not only economic value but also social, cultural, and spiritual significance for indigenous communities. Although the rights of indigenous peoples are recognized by the Indonesian Constitution and the Basic Agrarian Law, the implementation of legal protection for ulayat land still faces challenges in the national land administration system. This research uses an empirical legal method with a descriptive qualitative approach supported by statutory analysis. Data were collected through interviews, observation, and document studies involving indigenous leaders, village officials, the local land office, and regional government stakeholders. The findings show that the certification process under Ministerial Regulation of Agrarian Affairs and Spatial Planning/National Land Agency Number 14 of 2024 consists of two main stages: ulayat land administration and ulayat land registration. In Tandula Jangga Village, the process has reached the stage of inventory, identification, measurement, mapping, and recording in the Ulayat Land Register, but has not yet continued to the issuance of a land use right certificate due to the absence of regional legal products recognizing the indigenous community. The study concludes that ulayat land certification serves as a preventive legal protection mechanism by providing legal certainty over subject, object, boundaries, and status of ulayat land, while also preserving its communal character. However, the effectiveness of this protection depends on formal recognition by local government and the completion of administrative requirements.
