Abstract

This research is motivated by the failure to register the outcomes of land mediation with the District Court, as mandated by Article 44 paragraph (5) of the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 21 of 2020. The study aims to examine the implementation of this requirement at the Bojonegoro Regency Land Office, identify the obstacles involved, and explore measures to strengthen mediation outcomes to ensure legal certainty for the parties concerned. The research findings indicate that mediation at the Bojonegoro Regency Land Office has successfully resulted in settlement agreements. However, these outcomes have not been registered with the District Court and, consequently, lack executory force. This situation stems from legal and practical obstacles in implementing Article 44 paragraph (5) of the aforementioned Regulation Number 21 of 2020. Therefore, implementation requires harmonizing Regulation Number 21 of 2020 with Supreme Court Regulation Number 1 of 2016, enhancing mediator capacity, and providing services that ensure legal protection and meet legal requirements for land mediation outcomes.
