Abstract
Land acquisition for public interest aims to provide land for development while ensuring fair and proper compensation for affected communities. However, in practice, compensation payment often encounters various obstacles that create legal uncertainty and social impacts. This research aims to analyze the implementation of compensation payment in the land acquisition process for the Southern Cross Road (Jalur Jalan Lintas Selatan/JJLS) Garongan–Congot section, identify the impacts experienced by affected communities, and evaluate the settlement mechanism based on applicable legal provisions. However, in practice, compensation payment often encounters various obstacles that create legal uncertainty and social impacts. This research aims to analyze the implementation of compensation payment in the land acquisition process for the Southern Cross Road (Jalur Jalan Lintas Selatan/JJLS) Garongan–Congot section, identify the impacts experienced by affected communities, and evaluate the settlement mechanism based on applicable legal provisions. The results indicate that the compensation payment process has not been fully implemented despite the completion of several land acquisition stages, including land inventory, appraisal, and compensation deliberation. The delay was mainly caused by the expiration of the Location Implementation Permit (IPL) and limited regional government budget allocation. Consequently, affected communities experienced economic losses, legal uncertainty, declining trust in the government, and social impacts due to the prolonged uncertainty. To resolve the issue, the government decided to conduct a new land acquisition process by preparing a new Planning Document for Land Acquisition (DPPT), obtaining a new location determination, and repeating several administrative stages in accordance with prevailing regulations. This settlement mechanism is legally consistent with applicable laws and regulations; however, it has not fully fulfilled the principles of justice and legal certainty because compensation has not yet been received by all entitled parties.
