Abstract

Land parcel overlap resulting in the annulment of land certificates indicates that the accuracy of land administration data is a crucial factor in ensuring legal certainty. This study aims to analyze the legal framework governing digital plotting of Cluster 4 (K4) land parcels, identify the forms and causes of administrative defects arising from the absence of digital plotting, and examine the urgency of its implementation as a preventive measure against administrative defects in land certificate issuance. This research employed a normative juridical approach with a descriptive qualitative method through a case study of the Semarang Administrative Court Decision Number 95/G/2024/PTUN.SMG. Data were collected through document analysis, literature review, documentation, document observation, and documented focus group discussions (FGDs), and were analyzed using a normative juridical approach. The study was grounded in Gustav Radbruch’s Theory of Legal Certainty, the General Principles of Good Governance, the Theory of Administrative Defects, Philipus M. Hadjon’s Theory of Legal Protection, Land Registration Theory, and the concept of digital public administration. The findings reveal that the administrative defects in the case resulted from the suboptimal implementation of K4 digital plotting, the lack of integration between physical and juridical data, land parcels that had not yet achieved landing status, and inadequate spatial verification prior to the issuance of the land certificate. The study concludes that K4 digital plotting is not merely a technical mapping activity but also a preventive legal instrument that plays a significant role in preventing overlapping land parcels, ensuring legal certainty, and supporting an accurate, integrated, and electronically based land administration system.
