Abstract
This study, titled "The Development of the Land Tenure System of the Samin Community in Klopoduwur Village, Blora Regency," aims to examine the history of initial land acquisition, the development of the land tenure system, and the land-related problems faced by the Samin community (Sedulur Sikep) along with their solutions. This research employs a descriptive qualitative method with phenomenological and historical approaches, through in-depth interviews with the Tribal Chief of Sedulur Sikep, community members, officials from the Land Office (BPN) of Blora Regency, as well as document studies, analyzed using the Miles & Huberman analysis technique and the theoretical frameworks of Living Law (Eugen Ehrlich), Beschikkingsrecht (Van Vollenhoven), and Beslissingenleer (Ter Haar). The results show that the initial acquisition of land by the Sedulur Sikep community took place through four mechanisms: babat alas (forest clearing), land distribution by customary leaders, inheritance based on the "sepikul segendongan" principle all of which relied on social recognition without any formal documentation. The land tenure system developed through four historical periods, from pure customary law to gradual formalization through the Complete Systematic Land Registration program (PTSL), with 10 of the 22 identified land parcels having been certified. Four main problems were identified: the erosion of customary values due to modernization, legal uncertainty over unregistered land, the absence of formal recognition as a customary law community, and the potential for conflicting claims with forest areas managed by Perhutani. Resolving these issues requires the active involvement of the Blora Regency Government and the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN).
