Abstract
Land is a strategic resource that continues to trigger conflicts of control and ownership across Indonesia, and Palu City faces particularly complex dynamics due to disputes emerging after the 2018 earthquake, tsunami, and liquefaction dis-aster. Boundary markers were lost and overlapping claims arose during rehabilita-tion and reconstruction, creating uncertainty in establishing rights status and prov-ing land history. The Palu City Land Office addresses this through mediation under Minister of ATR/BPN Regulation No. 21 of 2020, yet its effectiveness has not been comprehensively examined. This study aims to analyze the implementation of land dispute mediation, identify the reasons for mediation failures, examine the inhibit- ing and supporting factors, and formulate solutions to strengthen mediation prac-tice at the Palu City Land Office. This research employed a descriptive qualitative approach supported by ju-ridical-empirical analysis, conducted directly at the Palu City Land Office. Inform-ants were selected purposively, comprising the Head of the Dispute Control and Handling Section, the dispute team coordinator, section staff, mediation applicants or disputing parties, and external mediators. Data were collected through in-depth semi-structured interviews, direct observation of mediation facilities and services, and documentation studies of dispute statistics and mediation case files. Data anal- ysis followed the Miles and Huberman model, encompassing data collection, re-duction, display, and conclusion drawing/verification. The findings show that mediation implementation follows the stages regu-lated in Permen ATR/BPN No. 21/2020, beginning with complaint intake and pre-liminary review through to the drafting of mediation minutes and follow-up. Of 59 disputes handled between 2023 and October 2025, 31 cases (52.54%) were suc-cessfully resolved through mediation, 13 cases (22.03%) failed, and 15 cases (25.42%) remained in progress. The main causes of failure were the parties' lack of good faith, absence of a disputing party despite being summoned, incomplete physical and juridical data, and the high emotional value attached to land disputes. Inhibiting factors were both internal, such as limited human resources and mediator competence, and external, such as party non-cooperation and post-disaster bound- ary uncertainty, while supporting factors included the existing legal basis, the Dis-pute Control and Handling Section, and the community's deliberation culture. The study concludes that mediation has functioned as a viable alternative dispute resolution mechanism but requires strengthening to reduce failed and unre-solved cases. Recommended solutions include stricter adherence to the regulated case-handling stages, more thorough verification of physical and juridical data, enhanced mediator training in negotiation and socio-cultural understanding, im- proved documentation of summonses and mediation outcomes, and sustained public socialization of the mediation mechanism. These measures are expected to improve the effectiveness, fairness, and sustainability of land dispute resolution at the Palu City Land Office and to serve as a reference for similar institutions elsewhere.
