Abstract

Mediation is a process of resolving land disputes through negotiation facilitated by a mediator. The Bima Regency Land Office has experienced a high rate of mediation failure over the past five years, from 2020 to 2025, with only 5 of 58 cases (8.62%) successfully resolved, far below the West Nusa Tenggara provincial average (25.40%) and the national average (20.26%). This empirical legal research aims to analyse the implementation of land dispute mediation at the Bima Regency Land Office, identify the factors causing mediation failure, and formulate strategic efforts to enhance the effectiveness of mediation. This study employs a qualitative method with a case study approach involving six purposively selected cases, three successful (Dadibou, Sorolembo/Sampungu, and Kawinda To’i) and three unsuccessful (Boro, Oi Tui, and Sengiang), analysed using Christopher W. Moore’s mediation theory and Boulle and Alexander’s mediator role theory. The results show that the most determining cause of mediation failure is the lack of good faith and ego among the parties, followed by the absence of the parties, limited mediator competence, power imbalance, unclear legal status of the land, and limited facilities. To enhance the role of mediation, strategic efforts are required, including strengthening mediator capacity and certification, intensifying public socialisation involving traditional and religious leaders, utilising local cultural approaches, strengthening the summoning mechanism, improving facilities, and considering online mediation for distant parties. The Bima Regency Land Office is advised to routinely monitor and evaluate the mediation process to promote more effective land dispute resolution.
