Abstract

The land tenure conflict over village assets between Tegaldowo Village and PT Semen Indonesia (Persero) Tbk in Gunem, Rembang Regency, arose from nine Right to Use Certificates covering Brumbung Road, issued through the Complete Systematic Land Registration Program in 2023, which the company claimed fell within its mining permit area. This study analyzes the stages of the conflict, its underlying causes, and possible resolution alternatives. The research used a qualitative method with an empirical descriptive approach, through interviews with the village government, the company, the Rembang Land Office, and local residents. Findings show the conflict evolved according to Simon Fisher's stages, namely pre conflict, confrontation, crisis, outcome, and post conflict, driven by data conflict, conflict of interest, value conflict, and overlapping land use. Supreme Court Decision Number 538 K/TUN/2025 upheld the certificates after rejecting the company's lawsuit, yet left the substantive dispute over physical land control unresolved. The study concludes that settlement should be pursued through Alternative Dispute Resolution using a utilization cooperation scheme balancing the village asset's legality with the company's operational interests.
