Abstract

Unregistered or uncertified land often creates legal uncertainty, particularly when it is controlled by government agencies for public purposes. Such conditions may lead to disputes concerning land rights, legal protection, and compensation for the parties claiming ownership. This study aims to analyze the legal status of unregistered land, examine the forms of legal protection and compensation mechanisms, and assess the legal implications of Settlement Deed Number 12/Pdt.G/2020/PN Mkm for legal certainty in land administration. This research employed a normative juridical method with a case approach and descriptive qualitative analysis based on statutory regulations, legal documents, and Settlement Deed Number 12/Pdt.G/2020/PN Mkm. The results indicate that unregistered land cannot automatically be regarded as state land as long as valid evidence of ownership or possession exists. Legal protection was provided through dispute resolution resulting in a settlement agreement that included an ex gratia payment of IDR 150,000,000. The settlement deed provides a legal basis for land registration and certification, although it does not automatically change the administrative status of the land. Therefore, land registration remains necessary to ensure legal certainty and orderly land administration.
