Abstract

This research is motivated by the legal deadlock in the land dispute over former Eigendom Verponding in Dago Elos. The Supreme Court Decision Number 109 PK/Pdt/2022, which ruled in favor of the Muller heirs' civil claim, collides with a criminal court decision proving the forgery of the title documents. This study aims to analyze the legal standing of the community's physical (sporadic) possession and to formulate an administrative settlement scheme by the Land Office to provide legal certainty. The research method used is normative juridical with statutory, case, conceptual, and historical approaches. The results show that the disputed land has become state land due to the failure to convert the colonial land rights by the deadline of September 24, 1980. Based on Presidential Decree Number 32 of 1979, the application for land rights based on the community's physical possession holds priority status. Considering that a criminal decision does not automatically annul a civil decision but rather serves as grounds for a Judicial Review (Peninjauan Kembali), the Land Office has the authority to resolve the dispute progressively through administrative means—ranging from establishing a status quo, inventory by Committee A (Panitia A), to the granting of new rights. In conclusion, the community's physical possession has a strong juridical basis over state land, and the Land Office can resolve this dispute deadlock through administrative instruments without contradicting the court's decision.
