Abstract

This study examines the land acquisition mechanism for village land under Hak Anggaduh affected by the development of flood control and coastal protection infrastructure in the Yogyakarta International Airport (YIA) area,focusing on Kalurahan Palihan, Temon, Kulon Progo. The issue is significant because village land in the Special Region of Yogyakarta is governed simultaneously by the national land acquisition regime and the special land regime of the Kasultanan and Kadipaten. This research uses a descriptive qualitative method through semi- structured interviews, field observation, and document study involving the Land Office of Kulon Progo, BBWS Serayu Opak, the Palihan village administration, and the Yogyakarta Land and Spatial Planning Agency. The findings show that the general land acquisition stages under Law No. 2 of 2012 proceeded relatively smoothly for privately owned land, but the Hak Anggaduh parcel required an additional special-law pathway: consultation with Kadipaten Pakualaman, return of Hak Anggaduh, and issuance of palilah and kekancingan. The issuance of Governor Regulation No. 24 of 2024 changed the compensation orientation from replacement land to a lease-based mechanism, causing legal and administrative uncertainty. The study identifies conflicts of norms, ambiguity over the village government’s status as an entitled party, uncertainty over the meaning of “land acquisition” without release of rights, and weak protection for village economic benefits. A two-track model is proposed, provided that definitive kekancingan, written compensation for the village government, and regulatory harmonization are completed before the acquisition result is finalized.
