Abstract

This study examines the legal status of land tenure and use, as well as the legal authority and administrative responsibilities arising from the overlapping registration of government land assets in the Bungkutoko Port Area, Kendari. Employing an empirical legal approach and a descriptive qualitative method, the research utilizes primary data obtained through interviews and field observations, complemented by secondary legal materials from legislation, scholarly works, and relevant literature. The findings indicate that the overlap in asset registration stems from the coexistence of two legitimate bases of acquisition: land procured by the Government of Kendari City and recorded as Regional Government Property, and reclaimed land developed by the Ministry of Transportation and recorded as State Property. Although the operational management of the port area falls under the authority of the Ministry of Transportation through the Class II Harbormaster and Port Authority Office of Kendari, discrepancies between the initial asset records and the actual conditions identified during the inventory process resulted in dual registration. Resolution of the issue requires inter-agency coordination through joint inventory, data harmonization, correction of asset records, and the separation of registrations according to the legal basis of acquisition. The study highlights the necessity of synchronized data and institutional cooperation to ensure legal certainty and sound administration of government land assets.
