Abstract

The large scale fire that struck the Brebes Regency Land Office on 14 July 2023 caused severe damage to the physical archives and juridical records of the Complete Systematic Land Registration (PTSL) program, threatening the legal certainty of the community's land rights. This research aims to identify the policies adopted by the Brebes Regency Land Office in recovering the physical and juridical data of PTSL after the disaster, to analyze the implementation of those policies, and to evaluate their effectiveness along with the obstacles encountered. This study uses a qualitative method with a case study approach. Data were collected through in depth interviews, field observations, and documentation studies, with informants determined through purposive sampling from parties directly involved in the disaster recovery team and the PTSL Adjudication Committee. The results show that the recovery policy was carried out through three main steps: data inventory and the issuance of replacement certificates based on Head of BPN Regulation Number 6 of 2010, the destruction of archives damaged by more than 60% in accordance with Head of ANRI Regulation Number 23 of 2015, and a relaxation policy in the form of non tax state revenue (PNBP) exemption for the affected community. Implementation relied on the Land Office Computerization System (KKP) as a temporary data backup and successfully recovered 1,017 PTSL plots/files spanning the years 2018-2023. Nevertheless, the recovery process still faced obstacles such as low public legal literacy, which led the community to perceive the fire as institutional maladministration, as well as delays in obtaining archive destruction permits from ANRI. This research concludes that the incident underscores the urgency of accelerating digital transformation, particularly the optimization of Electronic Certificates, as a long term mitigation measure to reduce dependence on physical archives.
