Abstract
Land disputes remain one of the most persistent legal issues in Indonesia, often creating uncertainty regarding land ownership and legal protection. Mediation, as regulated under the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency (ATR/BPN) Number 21 of 2020 concerning the Handling and Settlement of Land Cases, is intended to provide an effective non-litigation mechanism for resolving land disputes. This study aims to analyze the effectiveness of the role of the Bengkulu City Land Office in facilitating land dispute mediation, examine the contribution of mediation to enhancing legal certainty, and identify the obstacles and improvement strategies in its implementation. This research employed a qualitative approach with an empirical juridical method. Primary data were obtained through interviews with officials of the Bengkulu City Land Office and parties involved in land dispute mediation, while secondary data were collected through the analysis of legislation, official documents, and relevant literature. The collected data were analyzed using descriptive qualitative analysis to interpret the implementation of mediation based on the applicable legal framework and empirical findings. The findings indicate that the mediation process conducted by the Bengkulu City Land Office has generally been implemented in accordance with the procedures stipulated in Ministerial Regulation of ATR/BPN Number 21 of 2020. The Land Office has performed its role as a neutral mediator by facilitating dialogue, encouraging consensus, and providing administrative follow-up for mediated agreements. However, the overall effectiveness of mediation remains limited due to several factors, including the lack of good faith among disputing parties, the complexity of land disputes, incomplete land administration documents, limited public understanding of mediation, and the varying competence of mediators. During the 2021–2025 period, the mediation success rate reached only 30.77%, indicating that procedural compliance has not yet been fully translated into optimal substantive outcomes. Consequently, the effectiveness of mediation should not be assessed solely by the number of successful settlements but also by its ability to create legal certainty, ensure justice, and provide practical benefits for society. This study concludes that land dispute mediation constitutes an important instrument for strengthening legal certainty outside the court system. Nevertheless, improving its effectiveness requires strengthening mediator capacity, enhancing land administration systems, accelerating the digitalization of land services, and increasing public legal awareness regarding mediation and land rights.
