Abstract
This study aims to analyze the mechanism for resolving historical land conflicts through Land Consolidation in the development of permanent housing (Huntap) for post-disaster recovery in Petobo Village, Palu City, and to evaluate its effectiveness based on the principles of social justice and legal certainty. The 2018 earthquake and liquefaction disaster not only destroyed the physical spatial structure but also exacerbated long-standing land conflicts, thereby necessitating a more precise policy for the restructuring of land tenure and ownership. This research employed a descriptive qualitative method with a case study approach. Data were collected through in-depth interviews, field observations, and document analysis, and were subsequently analyzed using data triangulation techniques. The findings (Das Sein) indicate that the resolution of land conflicts was implemented through the verification of land tenure history, the application of the Land Contribution for Development (Sumbangan Tanah untuk Pembangunan/STUP) mechanism, and the issuance of land title certificates. Administratively, the Land Consolidation program successfully secured land for permanent housing and provided legal certainty for the majority of participants. However, the gap analysis (Das Sollen versus Das Sein) reveals the persistence of legal positivism in the implementation of the policy. Disaster-affected residents who had de facto possession of land but lacked formal evidence of ownership were not adequately accommodated. In addition, differing perceptions regarding the proportion of STUP indicate that the principle of deliberation and consensus was not fully achieved. To address these shortcomings, post-disaster land conflict resolution should not rely solely on formal legal mechanisms. Affirmative policy discretion is required by recognizing rights based on communal land tenure or social witness testimony to protect affected residents who are unable to provide formal legal evidence. Furthermore, the refinement of the Land Consolidation framework should place humanitarian values and social justice as fundamental prerequisites to ensure that the restoration of post-disaster civil property rights can be achieved comprehensively and sustainably. Keywords: Land Consolidation, land conflict, social justice, legal certainty, permanent housing.
