Abstract
Pulau Bungin, Sumbawa Regency, is inhabited by the Bajo people, who facing land scarcity and expand their settlement through self-help (traditional) reclamation by piling dead coral rock onto the sea. Over this reclaimed land the State, through ATR/BPN, has issued land rights, including Freehold Title (Hak Milik) via the Complete Systematic Land Registration (PTSL) program, even though authority over marine space of 0–12 nautical miles rests with the provincial government and the reclamation was carried out without a formal permit. This study analyzes the conformity of granting land rights over such traditionally reclaimed land with prevailing land and coastal spatial regulations. It uses a qualitative descriptive (empirical-juridical) method through in-depth interviews with key informants, documentary study, and regulatory analysis. The results show that land tenure evolved from unwritten custom to village certificates (locally called “Segel”) and finally to PTSL certification, with solid reclaimed land recognized as an object of land rights. However, the granting is only partially conform. Appropriate for long- established inland parcels historically occupied by the Bajo, but not conform for parcels within coastal-boundary or protected zones. Which should carry time- limited rights (Hak Pakai) rather than Hak Milik, and given the absence of cross- sector coordination prior to certification. Resolution is directed toward Government Regulation No. 43 of 2021, balancing legal certainty with the principle of benefit (asas kemanfaatan) for the Bajo community.
