Abstract
State assets, including land controlled by the central or regional government, must be certified in the name of the relevant central or regional government to ensure legal certainty over the land's status. Land assets also require safeguards through administrative, physical, and legal safeguards to prevent unauthorized use and exploitation of the land by third parties. For example, land belonging to the Yogyakarta City Government, designated as an educational facility at Gambiran Public Elementary School, is currently partially used by residents for residential housing and residential road access. This study aims to analyze the factors leading to this government-owned land occupation and to identify the mechanisms for resolving the situation. The research method used is empirical juridical research with a qualitative approach. Data were obtained through interviews with the Yogyakarta City Land and Spatial Planning Office, the Regional Financial and Asset Management Agency, the Public Works, Housing, and Settlement Areas Office, the Gambiran Public Elementary School, the Pandeyan Village Head, and the local community, supported by documentary studies. The research results indicate that land occupations occur not due to ownership disputes, but rather due to suboptimal physical asset security, mismatches between legal and physical boundaries, lack of information regarding land status, and socio-economic factors within the community. Resolutions are achieved through re-measurement, boundary re-establishment, cross-agency coordination, mediation with the community, and area restructuring through the Munggur, Munggah, Madep Kali (M3K) Program. The research concludes that land certification is insufficient to protect government assets without physical security and ongoing monitoring.
