Abstract

Land conflict between indigenous communities and local government remains a persistent agrarian issue in Indonesia, particularly in regions with strong customary land tenure, such as Merauke Regency. This study analyzes the historical chronology and root causes of ulayat (customary) land conflict between the Marind-Anim indigenous community and the Merauke Regency Government, examines the perceptions and strategies employed by the indigenous community in defending their customary rights, and identifies the social, economic, cultural, and administrative impacts of the conflict. A descriptive-qualitative phenomenological approach was used, with data gathered through in-depth interviews, non-participatory observation, and documentation involving purposively selected informants from the local government, the Merauke Land Office, customary leaders, and affected community members. Data were analyzed using the Miles and Huberman interactive model, comprising data reduction, data display, and conclusion drawing, with credibility ensured through source and technique triangulation and member checking. Findings show that the conflict stems from accelerating development, weak land administration marked by the absence of comprehensive customary land mapping, and divergent views between government and indigenous actors regarding land function. Indigenous communities defend their rights mainly through customary deliberation rather than confrontation, while the conflict generates multidimensional social, economic, cultural, and administrative impacts.
