Abstract

Special Region of Yogyakarta Governor Regulation No. 24 of 2024 stipulates that if village land is used by the village government or other parties for non- agricultural activities, or if it is rezoned for non-agricultural activities, written permission must be obtained from the Sultanate (Kasultanan) or Principality (Kadipaten) and the Governor. Therefore, Pengasih Village submitted an application for permission to use village land. However, this application is still facing obstacles. In light of this, a study was conducted to examine the process, obstacles, and solutions applied in the issuance of this permit. The research method used was qualitative analysis with a descriptive approach, specifically to explore the process of issuing the permit for the use of Pengasih Village land. Research findings indicate that the process for issuing permission for the use of village land includes submitting an application, the issuance of a recommendation by the Regent, verification of documents by the Land and Spatial Planning Agency of Special Region of Yogyakarta (DPTR DIY), a coordination meeting and on-site inspection, submission of a permission recommendation to the Sultanate (Kasultanan) or Principality (Kadipaten), submission of a permission recommendation to the Governor through the Legal Bureau of the Special Region of Yogyakarta Secretariat, and finally, the issuance of the Governor’s Decree regarding the Village Land Use Permission. However, this process doesn’t always run smoothly. There are several obstacles, such as the lack of Technical Implementation Guidelines accompanying Special Region of Yogyakarta Governor Regulation No. 24 of 2024, limited human resources at the Land and Spatial Planning Agency of Kulon Progo Regency and the Pengasih Village Government, incomplete or non compliant application documents, and time constraints. Solutions to these obstacles have also been implemented, such as creating sample forms for required documents, improving the structure of the permitting process, coordinating between the Kulon Progo Regency DPTR and the Pengasih Village Government s well as other users, and improving the process for correcting incomplete or non- compliant documents.
