Abstract

Land acquisition for public interest serves as a government instrument to support national development while ensuring legal protection for the public's land rights. However, implementation issues persist, notably disputes regarding the determination of parties entitled to compensation. Such a dispute arose during the construction of the Solo–Yogyakarta–Kulon Progo Toll Road—addressed in Yogyakarta Administrative Court Decision Number 5/G/2025/PTUN.YK—concerning the "Nominative List Verification II Number 088/DN-Peng.Tn.34.01/XI/2024." This study aims to analyze regulations and policies on land acquisition for public interest, the complexities of disputes regarding the determination of compensation recipients, the legal consequences of accepting compensation on the right to file objections or lawsuits, and legal remedies for parties omitted from the nominative list of recipients. The study employs a normative legal research method utilizing statutory, case, and conceptual approaches. Data were gathered through a literature review of laws, court decisions, and relevant academic sources, then analyzed qualitatively using a descriptive-analytical method. Te findings indicate that land acquisition is supported by a comprehensive legal framework—specifically Law Number 2 of 2012 and its implementing regulations. Nevertheless, practical issues regarding the verification and determination of entitled parties continue to trigger administrative disputes. The study also reveals that accepting compensation does not extinguish an individual's right to file an objection or lawsuit if the dispute concerns the validity of an Administrative State Decision. Therefore, the verification process must be conducted meticulously, transparently, and accountably to ensure legal certainty, fairness, and legal protection for all parties involved in land acquisition. Keywords: land acquisition, administrative state dispute, nominative list, compensation, certainty
