Abstract

The liquefaction natural disaster that affected the subject and object of rights in Petobo Village, became a trigger for the loss of an explicit and clear impression of the legal status of land rights in post-disaster locations. The purpose of this study is to simultaneously determine the status of land rights affected by liquefaction whether it is appropriate to be declared destroyed or not and to find out recommendations in policy making by the government or related agencies on the status of land rights affected by liquefaction. The research method that the author will use in this study is a normative legal research method with the data processed and analyzed qualitatively. The conclusions of this study are (1) the legal status of land rights after the liquefaction of Petobo Village is in the status quo (2) Carry out land acquisition as the basis for land acquisition which will be used as RTH or Disaster Monument and the local government and related agencies must accommodating the right holder on the affected right’s object to relinquish their rights on land.
