Abstract

Contradiction policy of stopping the issuance of new permits in forest and peat areas in land registration. On the one side, the government through the ministry of agrarian and spatial planning/National Land Agency has a land registration program through PTSL with acceleration on the order of Presidential Instruction Number 2 of 2018, so that the land registration process in Indonesia can be completed. On the other side, the government also trying to protect the existence of peatlands that have ecological functions, so it’s necessary to controlled the land changed and tenure by Presidential Instruction Number 5 of 2019, with an indicative map policy for granting new permits to natural forests and peatlands set by the Minister of Environment and Forestry. The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency implements it differently, with the instructions mandated in Presidential Instruction Number 5 of 2019 regarding the land registration process, a strategy for completing the registration of peat land is needed, especially in the APL PIPPIB area of peatland. Communities who own land in Air Hitam Village cannot complete the process of issuing permits and registering land, before interested parties receive a letter of clarification from the Director General of Forestry Planning and Environmental Management. So this research was conducted with the aim of knowing the occurrence of overlapping regulations regarding registration of land, peatland, and PIPPIB, and knowing the structure of P4T on spatial planning policies, and PIPPIB. The author uses a purposive sampling technique in determining the sample. This research used a qualitative method with a normative juridical approach with a comparative analysis technique, and a spatial approach with an overlay technique.The results of regulatory with comparative analysis show to indicated overlapping regulations in their implementation. The results of the spatial data overlay analysis show that the affected area is about 66% to Air Hitam village area, and also is not included in the 2018 RTRW Riau Province, while the Pekanbaru City RTRW in 2020 only contains peat protected areas which are not suitable at all. Conclusion, there is a policy context in the land sector and the uncertainty of the requirements for the object of the exception to the PIPPIB policy on the results of the request for clarification. Land policy ecommendations are needed as material for the strategy for completing land registration on APL PIPPIB peatlands, namely: (1) integrated land services; (2) structuring land policy; and (3) lawsuit to the state administrative court.
