Abstract

Cluster 3 is a Pendaftaran Tanah Sistematis Lengkap (PTSL) product where data collection has been carried out on PTSL objects, but certificates cannot be issued for several reasons, such as PTSL objects being in forest areas, the absence of SHAT budgets, and PTSL subjects do not want to register their land for certification. PTSL itself aims to accelerate the provision of legal certainty of land rights for the community, but the land plots included in cluster 3 can hinder the achievement of this goal, because the land plots of cluster 3 are only measurable but cannot be issued certificates. Cluster 3 in the implementation of PTSL in Pati Regency as many as 83,873 fields, this number is the accumulation of cluster 3 from 2019 to 2021 and there have been no significant efforts made by the Pati Regency Land Office to suppress or solve the problem of cluster 3. The purpose of this research is to find out what are the factors that cause the occurrence of the cluster 3 and the impacts caused and also what efforts can be made to solve the problems of cluster 3 in Pati Regency. The method used in this study is qualitative with a phenomenological approach. The results of research that have been carried out in two villages in Pati Regency, namely Prawoto Village and Wegil Village, it is known that the factors causing the occurrence of cluster 3 are unproductive soil conditions, the delivery of information on the implementation of PTSL that is not conveyed to the community, community pessimism towards the land program, the ease of submitting KUR which can be given by guaranteeing sppt only and the transfer of shat budget in the implementation of PTSL in 2021. There is no negative impact or the community feels disadvantaged on their land which is included in cluster 3, precisely with the existence of cluster 3 the community is helped where if in the future the community wants to increase the status of their land to a certificate, the community no longer needs to pay measurement fees, because it has been measured at the time of implementing PTSL. Efforts that can be made to reduce the number of cluster 3 in Pati Regency are socializing about land administration from the district level to the village level, carrying out reform access activities for villages where there are unproductive land locations for the community, synergizing with banks and the Pati Regency Land Office must be more responsible for the work done.
