Abstract

The division of territories due to the Giyanti Agreement and the Salatiga Agreement left a heritage of the Kasunanan and Mangkunegaran eks-territories located in DIY. The eks-territory is now called by the eks-enclave. The locations of the eks-enclave areas are spread across several sub-districts in Gunungkidul Regency and Bantul Regency. According from the information, some land in the eks-enclave area cannot be certified. The aim of this research is to determine the obstacles in certifying land in eks-enclave areas, strategies to legitimate the land to be certified in eks-enclave areas, as well as the potential value of benefits after certified. The method used in this research is qualitative with a normative - empirical approach. The results obtained in this research were that 90 plots of land were found in the eks-enclave area which had the potential to certified and getting the land rights. The obstacles that hinder land certification in eks-enclave areas are caused by unclear land status and doubts in determining the subject of rights. The strategy that can be used to overcome this problem is determining state land status on eks-enclave land based on its history which has been reviewed by the GTRA Team and the Ministry of ATR/BPN through a study of the status of eks-enclave. Once the status is clear, it can be followed up by strengthening rights by determining the subject of rights based on land control and use. Strengthening these rights has the potential for legal protection and certainty of land rights, cultural heritage protection for the Imogiri King's Tomb, and increasing community welfare through access regulations.
